General Information
This document sets out the terms of the Privacy Policy for the Online Store (hereinafter referred to as the “Online Store”). The Administrator of the Online Store is Małgorzata Bargielska, conducting business under the name Hauke Małgorzata Bargielska, entered into the Register of Entrepreneurs of the Central Registration and Information on Business, maintained by the Minister of Entrepreneurship and Technology, at ul. Capitalized words have the meanings given to them in the terms and conditions of this Online Store.
Personal data collected by the Online Store Administrator are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, p. 1), hereinafter referred to as the GDPR.
The Online Store Administrator takes special care to protect the privacy and information provided to it regarding Online Store Customers. The Administrator carefully selects and applies appropriate technical measures, including programming and organizational measures, to ensure the protection of processed data. In particular, it protects data against unauthorized access, disclosure, loss, destruction, unauthorized modification, and against processing in violation of applicable law.
The use of the Goods and Services available on the website is not intended for children under the age of 16. The Personal Data Controller does not intend to intentionally collect data relating to children under the age of 16.

Purposes and legal basis for personal data processing
The Personal Data Controller processes your personal data for the following purposes and scope:
taking steps prior to entering into a contract at your request (e.g., creating an account), i.e., the data provided in the registration form in the Online Store, i.e., email address and password, gender; if Account registration is performed via an external authentication service (e.g., Google+, Facebook), we collect your name and surname, and if you register to purchase Goods, we collect your name and surname and the data provided for the purpose of order fulfillment, such as the shipping address; To provide Services that do not require the creation of an Account or the purchase of Goods, such as browsing the Online Store and searching for Goods, we process personal data related to your activity in the Online Store, including data regarding the Goods you browse, your device session data, operating system, browser, location, and unique ID, and IP address.
To perform the sales contract for Goods (e.g., to deliver the ordered Goods), we process the personal data you provide when purchasing Goods, such as your name, email address, address details, payment details, and, if you make a purchase via an Account, the password you set.
To compile statistics on the use of individual functionalities available in the Online Store, facilitate the use of the Online Store, and ensure the IT security of the Online Store, we process personal data related to your activity in the Online Store and the amount of time spent on each subpage of the Online Store, your search history, location, IP address, device ID, data related to your web browser, and operating system. In order to establish, pursue, and enforce claims, as well as defend against claims in court proceedings and before other enforcement bodies, we may process your personal data provided when purchasing Goods or creating an Account, as well as other data necessary to prove the existence of a claim or arising from a legal requirement, court order, or other legal procedure;
In order to process complaints, grievances, and requests, and to respond to Customer questions, we process the personal data you provide in the contact form, complaints, grievances, and requests, or to respond to questions in any other form, as well as certain personal data you provide in your Account, as well as data relating to the order for Goods and other Services provided by us that are the reason for the complaint, grievance, or request, and data related to the processing of such complaints, grievances, and requests.

For the marketing of our Products and Services and those of our customers and partners, including remarketing, we process the personal data you provide when creating and updating your Account, data regarding your activity in the Online Store, including orders, which are recorded and stored via cookies, in particular your order history, search history, clicks in the Online Store, login and registration dates, and your activity related to our communications with you. In the case of remarketing, we use data about your activity to reach you with our marketing messages outside the Online Store and use the services of external providers for this purpose. For the organization of competitions and loyalty programs, such as notifications of accumulated points, notifications of winnings, and advertising our offers, we use your personal data provided in your Account and when registering for a competition or loyalty program. Detailed information on this subject is provided in each individual competition or loyalty program’s terms and conditions;
for market and opinion research purposes conducted by us or our partners, i.e., order information, your data provided in your Account or when purchasing a Product, and your email address. Data collected as part of market and opinion research is not used by us for advertising purposes. Detailed instructions are provided in the information about the specific survey or at the point where you enter your data.
Categories of Relevant Personal Data
The Personal Data Controller processes the following categories of relevant personal data:
contact details;
data regarding activity in the Online Store;
data regarding orders in the Online Store;
data regarding complaints and requests;
data regarding marketing services.
Voluntary provision of personal data
Your provision of the required personal data is voluntary and is a condition for the provision of services by the Personal Data Controller via the Online Store.
Duration of data processing
Personal data will be processed for the period necessary to fulfill orders, services, marketing activities, and other services provided to the Customer. Personal data will be deleted in the following cases:
when the data subject requests its deletion or withdraws consent;
when the data subject takes no action for over 10 years (inactive contact);
after obtaining information that the stored data is outdated or inaccurate.
Some data, including email address, name, and surname, may be retained for a further 3 years for evidentiary purposes, for handling complaints, grievances, and claims related to the services provided by the Online Store – this data will not be used for marketing purposes.
Data regarding orders for paid goods and services, contests, and loyalty programs will be retained for a period of 5 years from the date of order delivery.
We retain data regarding unlogged Customers for a period corresponding to the life cycle of cookies stored on devices or until they are deleted from the Customer’s device by the Customer.
Your personal data regarding preferences, behavior, and selection of marketing content may be used as the basis for automated decisions to determine the Online Store’s sales opportunities.
Recipients of Personal Data
We transfer your personal data to the following categories of recipients:
state authorities, e.g., the prosecutor’s office, the Police, the Office of Personal Data Protection (PUODO), and the President of the Office of Competition and Consumer Protection (UOKiK), if they request it,
service providers we use to operate the Online Store, e.g., to fulfill orders. Depending on contractual arrangements and circumstances, these entities either act on our behalf or independently determine the purposes and methods of processing. Data Subject Rights
Under the GDPR, you have the right to:
request access to your personal data;
request rectification of your personal data;
request erasure of your personal data;
request restriction of personal data processing;

The Personal Data Controller will provide you with information about the actions taken in response to your request without undue delay—and in any case within one month of receiving your request. If necessary, this one-month period may be extended by another two months due to the complex nature of the request or the number of requests.

Right to access personal data (Article 15 of the GDPR)
You have the right to obtain information from the Personal Data Controller whether your personal data is being processed.
If the Controller processes your personal data, you have the right to:
access your personal data;
obtain information about the purposes of processing, the categories of personal data being processed, the recipients or categories of recipients of this data, the planned retention period of your data or the criteria for determining this period, your rights under the GDPR and the right to lodge a complaint with a supervisory authority, the source of this data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of this data outside the European Union;
obtain a copy of your personal data.

Right to rectification of personal data (Article 16 of the GDPR)
If your personal data is inaccurate, you have the right to request that the Controller immediately rectify your personal data.
You also have the right to request that the Controller complete your personal data.
If you wish to request that your personal data be corrected or supplemented, please submit your request to: hau@Hauke.pl.
If you have registered in the Online Store, you can correct and supplement your personal data yourself after logging in to the Online Store.
Right to erasure of personal data, the so-called “right to be forgotten” (Article 17 of the GDPR)
You have the right to request that the Controller delete your personal data when:
Your personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
You have withdrawn specific consent, to the extent that the personal data was processed based on your consent;
Your personal data was processed unlawfully;
You have objected to the processing of your personal data for direct marketing purposes, including profiling, to the extent that the processing of your personal data is related to direct marketing;
You have objected to the processing of your personal data in connection with processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of legitimate interests pursued by the Personal Data Controller or a third party.
Despite your request to erase your personal data, the Personal Data Controller may continue to process your data for the purpose of establishing, pursuing, or defending legal claims, of which you will be informed.

Right to request restriction of personal data processing (Article 18 of the GDPR)
You have the right to request restriction of the processing of your personal data when:
You contest the accuracy of your personal data – the Personal Data Controller will restrict the processing of your personal data for a period sufficient to verify the accuracy of this data;
When the processing of your data is unlawful, and instead of deleting your personal data, you request the restriction of the processing of your personal data;
Your personal data is no longer necessary for the purposes of processing, but is required to establish, pursue, or defend your claims;
When you have objected to the processing of your personal data – until it is determined whether the legitimate interests of the Personal Data Controller override the grounds indicated in your objection.

Right to object to the processing of personal data (Article 21 of the GDPR)
You have the right to object at any time to the processing of your personal data, including profiling, in connection with:
processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of legitimate interests pursued by the Personal Data Controller or a third party;
processing for direct marketing purposes.

Right to request personal data portability (Article 20 of the GDPR)
You have the right to receive your personal data from the Personal Data Controller in a structured, commonly used, and machine-readable format and to transmit it to another personal data controller.
You may also request that the Personal Data Controller transmit your personal data directly to another controller (if technically feasible).

Right to withdraw consent
You may withdraw your consent to the processing of your personal data at any time.
Withdrawing consent to the processing of personal data does not affect the lawfulness of processing based on your consent before its withdrawal.

Complaint to the supervisory authority
If you believe that the processing of your personal data violates the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of alleged infringement.
In Poland, the supervisory authority under the GDPR is the President of the Personal Data Protection Office (PUODO).
